Welcome to HLP+. We're Healthy Living Proteins, a Florida family business making clean, third-party-tested collagen and colostrum supplements. These Terms of Service ("Terms") are the agreement between you and us when you use our website, place an order, subscribe to a product, or interact with HLP+ in any way.

We've tried to write these in plain English. Where we couldn't, we've kept the legal phrasing as short as possible. If anything here is unclear, email us at hello@healthylivingproteins.com and we'll explain.

By using our website or placing an order, you're agreeing to these Terms. If you don't agree, please don't use the site.

1. Who we are

"We," "us," "HLP+," and "Healthy Living Proteins" refer to Healthy Living Proteins LLC, located at 10977 49th Street North #5, Clearwater, FL 33762. "You" refers to anyone visiting our website or buying our products.

2. Eligibility

To buy from HLP+, you must be at least 18 years old and able to enter a binding contract under the laws of your state and country. We ship to the United States only. If you're outside the US, you can browse but you can't purchase directly from us yet.

If you're buying for someone else (a family member, a friend, your mom), that's fine — but you're still the person responsible for the order under these Terms.

3. Your account

If you create an account on our site, you're responsible for keeping your password secure and for everything that happens under your account. If you notice unauthorized access, email us immediately at hello@healthylivingproteins.com.

We may suspend or close an account that we reasonably believe is being used to abuse our refund policy, defraud us or other customers, scrape our site, or violate these Terms.

4. Orders, prices, and payment

When you place an order, you're making us an offer to buy. We accept that offer when we send you an order-confirmation email. Until then, we may refuse or cancel any order for any reason — for example, if a product is out of stock, if there's a pricing error, or if we suspect fraud.

Prices are shown in US dollars and don't include taxes. Sales tax is calculated at checkout based on the shipping address. Prices can change without notice; the price that applies to your order is the one shown at checkout.

Payment. We accept the major credit cards and digital wallets our checkout displays. By providing payment details, you authorize us (and our payment processor) to charge the full order amount.

5. Subscriptions (Subscribe & Save)

Some HLP+ products are available on a recurring subscription through our subscription provider (Kaching). If you subscribe, here's how it works — and these Terms supplement, but don't replace, the subscription provider's own terms.

By starting a subscription you agree to the following, which is required disclosure under applicable state laws including California's Automatic Renewal Law (CA Bus. & Prof. Code §17600 et seq.), New York's similar statute, and Florida's auto-renewal statute (Fla. Stat. §501.165):

• What you're signing up for. A recurring shipment of the HLP+ product(s) you selected at the cadence you chose (typically every 30 days), at the subscription price shown at the time you signed up.
• How you'll be charged. Your payment method will be automatically charged for each renewal order at the subscription price until you cancel. Discounts (such as "subscribe and save 15%") apply to each renewal so long as the subscription is active.
• Length of the term. Your subscription continues indefinitely on the cadence you selected until you pause, skip, or cancel it.
• How to cancel. You can pause, skip, or cancel anytime from your account dashboard. No phone call, no chat queue, no minimum number of orders, no penalty. Cancellation takes effect immediately for any shipment that hasn't already been processed.
• Reminder notifications. Where required by applicable state law, we will send you an email reminder before each renewal charge.
• Price changes. If we change the subscription price, we'll notify you by email at least 30 days before the new price takes effect, and you can cancel before the new price applies.

If a subscription order has already shipped before you cancel, you have the full 30-day money-back guarantee to return it under our Refund Policy.

6. Shipping and delivery

Shipping is governed by our Shipping Policy. Risk of loss for physical products passes to you when the carrier accepts the package from us — but if a package is lost or damaged, contact us and we'll make it right per the Shipping Policy.

7. Returns and refunds

Returns and refunds are governed by our Refund & Return Policy. The short version: every HLP+ purchase comes with a 30-day money-back guarantee, opened or unopened, return shipping paid by us.

8. Product information and supplement disclaimers

HLP+ products are dietary supplements — not drugs. We work hard to describe our products accurately, including ingredients, formulation, sourcing, and third-party testing. We cannot promise that any product will produce a specific result for you. Bodies differ. Routines differ.

These statements have not been evaluated by the Food and Drug Administration. HLP+ products are not intended to diagnose, treat, cure, or prevent any disease. The information on this site is for general educational purposes only and is not medical advice. Consult with your doctor or other qualified healthcare professional before starting any new supplement, especially if you are pregnant, nursing, taking medication, under 18, or being treated for any health condition.

9. Intellectual property

The HLP+ name, the "HLP+" logo, our packaging design, our website copy, our images, and the structure of our site are owned by Healthy Living Proteins LLC or our licensors. You may not copy, reproduce, sell, or redistribute any of it without our written permission — except for personal, non-commercial use (like sharing a product link with a friend).

You may post photos or short reviews of HLP+ products on social media without asking us. We love that. But you may not use the HLP+ name or logo to imply we endorse you, your business, or another product without written permission.

10. Reviews, comments, and user-generated content

If you submit a review, comment, photo, or other content to our site (or tag us on social media), you're granting us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content for promotional and operational purposes — for example, on our product pages, in ads, in social posts, or in emails.

By submitting content, you confirm: you own it (or have permission to use it), it's truthful (especially if it's a review of how the product worked for you), it doesn't violate anyone else's rights, and it isn't unlawful or defamatory.

We may remove any user content at any time for any reason — for example, if it's spam, off-topic, abusive, or violates these Terms.

11. SMS marketing (if you opt in)

If you opt in to receive HLP+ text messages — by entering your phone number on our site, checking a checkout SMS-consent box, or texting a keyword to our short code — you're consenting to receive automated marketing text messages from HLP+ at the number you provided, including order updates, promotions, and product news.

• Consent is not a condition of purchase. You can buy from HLP+ without opting in to SMS.
• Frequency. Up to 10 messages per month.
• Message and data rates may apply, depending on your mobile carrier.
• Reply STOP to any HLP+ message to unsubscribe. Reply HELP for help. You can also email us at hello@healthylivingproteins.com.

This program is governed by the federal Telephone Consumer Protection Act ("TCPA") and applicable state laws.

12. Email marketing

If you sign up for HLP+ emails, you'll receive marketing messages, product updates, and content from us. You can unsubscribe at any time using the link at the bottom of any HLP+ email. We comply with the federal CAN-SPAM Act and applicable state laws.

We never sell or rent your email address. Our full Privacy Policy lives at Privacy Policy.

13. Things you agree not to do

When using our website or interacting with HLP+, you agree NOT to:

• Use the site for any unlawful purpose.
• Try to gain unauthorized access to our systems, customer data, or order information.
• Use bots, scrapers, or automated tools to copy our content, harvest email addresses, or place orders.
• Resell HLP+ products on Amazon, eBay, Faire, or any other marketplace without our written authorization (we control our authorized resellers carefully).
• Submit fake or paid-for reviews, or misrepresent your experience with our products.
• Use HLP+ branding, copy, or images to make false or misleading claims about other products.
• Interfere with the operation of our site or our customer service team.

If we have a reasonable belief that you've violated any of these, we may suspend your account, cancel your orders, ban future orders, and pursue any remedies available to us under applicable law.

14. Disclaimers of warranties

Except as required by applicable law, our website and our products are provided "as is" and "as available." To the maximum extent permitted by law, HLP+ disclaims all express and implied warranties — including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability — except as expressly stated in our Refund Policy and these Terms.

This does not affect any rights you have as a consumer under applicable mandatory law that cannot be waived.

15. Limitation of liability

To the maximum extent permitted by law, HLP+ (including our officers, employees, and contractors) will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, loss of business, or personal injury — arising out of or related to your use of the site or our products, even if we've been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of these Terms or your use of the site, whether in contract, tort, or otherwise, will not exceed the greater of (a) the amount you paid us for the product(s) giving rise to the claim, or (b) one hundred US dollars ($100).

Some states do not allow limitations on implied warranties or exclusion of certain damages. If you live in one of those states, some of the above may not apply to you, and you may have additional rights.

16. Indemnification

You agree to indemnify, defend, and hold harmless HLP+, its owners, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your misuse of our products or website, (c) your violation of any law or third-party right, or (d) any content you submit to us.

17. Governing law

These Terms and any dispute arising out of them are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Subject to Section 18 (Dispute Resolution), the state and federal courts located in Pinellas County, Florida have exclusive jurisdiction over any non-arbitrable dispute.

18. Dispute resolution — please read carefully

Step 1 — Try us first. If you have a problem with HLP+, please contact us at hello@healthylivingproteins.com before filing any formal action. We're a small family business and we genuinely want to fix things. Most disputes resolve within a single email exchange.

Step 2 — Binding arbitration. If we can't resolve a dispute informally within 60 days, you and HLP+ agree that the dispute will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will take place in Pinellas County, Florida, or by phone or video at your option. The arbitrator's decision is final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

Step 3 — Class action waiver. You and HLP+ agree that disputes will be brought only in your or our individual capacity, not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate claims or preside over a class action.

Opt-out. You may opt out of this arbitration provision by sending written notice to hello@healthylivingproteins.com within 30 days of first accepting these Terms. The notice must include your name, address, order number (if applicable), and an explicit statement that you opt out of arbitration.

Small-claims exception. Either party may bring a qualifying claim in small-claims court instead of arbitration, so long as the claim is brought on an individual (non-class, non-representative) basis.

Exceptions for IP. Notwithstanding the above, either party may bring an action for injunctive relief in court to protect intellectual property rights without first arbitrating.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top and, for material changes, we'll notify you by email or by a clear notice on the site. Continued use of the site or placement of new orders after a change means you accept the updated Terms.

For existing subscriptions, material changes to subscription pricing or cadence are also governed by Section 5 (Subscriptions).

20. Miscellaneous

Entire agreement. These Terms, together with our Shipping Policy, Refund & Return Policy, Privacy Policy, and any other policies linked from them, are the entire agreement between you and HLP+ regarding the subjects they cover.

Severability. If any provision of these Terms is found unenforceable, the rest of the Terms remain in effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms without our consent. We may assign these Terms to a successor (for example, in connection with a sale of the business).

Force majeure. We are not liable for delays or failures caused by events outside our reasonable control (severe weather, carrier failures, pandemics, government action, etc.).

Survival. Sections 8 (Disclaimers), 14 (Warranties), 15 (Liability), 16 (Indemnification), 17 (Governing Law), and 18 (Dispute Resolution) survive termination of these Terms.
